Terms and conditions of participation for the competition

The association EMN Europäische Metropolregion Nürnberg e. V. is offering a competition with a prize draw as part of the app “InnoHikes”. Various challenges can be played in the app, whereby the players can collect points and raffle tickets by reading texts, solving quiz questions and submitting evaluations. The more challenges are played, the more tickets the players receive, which increases their chances of winning the raffle. In order to participate in the raffle with the raffle tickets collected in the app, the user name selected in the app must be registered via the raffle form. Participation in the prize draw is possible from the launch of the app on 19.10.2022 until 16.04.2023. The winners will be drawn after 16.04.2023.

§ 1 Competition/rights of use

  1. Participants take part in the competition by collecting tickets in the “InnoHikes” app, registering for the competition via the link https://innohikes.de/gewinnspiel/ and fulfilling the conditions of participation. Participation must take place within the period stated in the competition. Participants are responsible for the accuracy of their e-mail address in particular.
  2. The competition is organised by the association EMN Europäische Metropolregion Nürnberg e. V. (hereinafter referred to as association EMN).

 

§ 2 Participants

  1. Persons over the age of 14 are entitled to participate. Minors require the consent of a parent or guardian to participate.
  2. In order to participate in the competition, it is absolutely necessary that all personal details are true. Failure to do so may result in exclusion pursuant to § 3 (4).

 

§ 3 Exclusion from the competition

  1. Employees of the EMN Association and the project partners INCLUSIFY AG and JOSEPHS GmbH as well as their respective relatives are excluded from participation.
  2. In the event of a breach of these conditions of participation, the EMN association reserves the right to exclude persons from the competition.
  3. Persons who use unauthorised aids or otherwise gain an advantage through manipulation will also be excluded. In such cases, prizes may also be subsequently disallowed and reclaimed.
  4. Anyone who provides false personal details will also be excluded.

 

§ 4 Implementation and handling

  1. The winners will be notified by the EMN Association in writing by e-mail.
  2. The item presented as a prize in the competition is not necessarily identical to the item won. Rather, there may be deviations with regard to model, colour or the like. The prize sponsor may select an item of average type and quality equivalent to the item presented as a prize.
  3. The 1st-3rd prize will be awarded at the closing event of the “InnoHikes”. The date of the event will be announced by mail in due time. The other prizes will be sent by Verein EMN or a third party commissioned by Verein EMN by forwarding agent, parcel service or post to the postal address to be provided by the winner. Delivery will only be made within the Federal Republic of Germany. Delivery is free of charge.
  4. If the delivery of the prize is not possible or only possible under unreasonable circumstances, the winner will receive a replacement of equal value. The winner will also receive a replacement of equal value if the original prize is no longer available in the version presented (change of model, seasonal goods, etc.).
  5. A cash payment of the winnings or a possible substitute for the winnings is not possible in any case.
  6. The claim to the prize or prize substitute cannot be assigned.
  7. The legal process is excluded.

 

§ 5 Premature termination of the competition

The EMN association reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. The EMN association will make use of this option in particular if the proper execution of the game cannot be guaranteed for technical reasons or for legal reasons. If such a termination is caused by the behaviour of a participant, the EMN association may demand compensation from this person for the damage incurred.

 

§ 6 Data protection

  1. It is a prerequisite for participation in the competition that the registration data mask is filled in completely. Participation in the competition is not possible without providing the user name, surname, first name and e-mail address.
  2. The names of the winners may be published on the portals of the EMN association. The winner expressly agrees to this form of publication.
  3. We will use your e-mail address to correspond with you (e.g. to notify you of your win). All compulsory details within the scope of registration are marked accordingly with (*). All other details are voluntary. The personal data will be used by us for the purposes described in each case. By entering the competition, you agree that we may process and use your personal data for the purposes of the competition.
  4. As a matter of principle, your personal data will not be passed on to third parties, not even in extracts, unless this is required by law or you have given your consent. In the case of a prize in kind, your data will be passed on to the cooperation partner commissioned with the delivery, insofar as this is necessary for the delivery/delivery of this prize to you. Insofar as we use service providers (IT service providers, printers, etc.) for the implementation and processing of the competition, the contractual relationships will be regulated in accordance with the provisions of the Federal Data Protection Act (BDSG).
  5. Declarations of consent can be revoked at any time without giving reasons with effect for the future at geschaeftsstelle@metropolregion.nuernberg.de. No special fees (beyond the regular transmission fees) will be charged for this. (Further) participation in the competition is not (no longer) possible if consent to the use of personal data within the scope of the competition is not given or revoked.
  6. The e-mails of the participants, including the personal data provided, will be deleted at the end of the competition after the prizes have been handed over to the winners.

 

§ 7 Liability/Salvatory clause

  1. The EMN Association shall be released from all obligations upon delivery of the prize, unless an earlier date is stipulated in these regulations.
  2. The EMN Association shall not be liable for material defects and/or defects of title in the prizes donated by the partner.
  3. The EMN Association shall not be liable for the insolvency of a partner or for the consequences resulting therefrom for the implementation of the competition.
  4. The EMN Association shall only be liable for damage caused by the EMN Association or one of its vicarious agents intentionally or through gross negligence or through the negligent breach of obligations which are essential for achieving the purpose of the contract. These limitations do not apply to damage caused by injury to life, limb and/or health or to liability under the Product Liability Act. The foregoing limitations of liability shall also apply in particular to damage caused by errors, delays or interruptions in transmission, in the event of malfunctions of technical equipment and the service, incorrect content, loss or deletion of data, or viruses.
  5. If any provision of these Terms and Conditions of Participation is or becomes invalid or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected thereby. The same applies if the conditions of participation contain a loophole. In place of the invalid and unenforceable provisions or to fill the loophole, a provision shall apply which, as far as legally possible, comes as close as possible to what the parties to the framework agreement intended or would have intended according to the meaning and purpose of the framework agreement if they had considered the point when concluding the framework agreement.
